5. Data protection
As the organiser of the competition, Eurowings processes personal data in order to carry out and process the competition and collects the following personal data: Surname, first name, company and email address. The legal basis for processing is contract fulfilment, Art. 6 para. 1 sentence 1 lit. b GDPR. Your personal data will be deleted as soon as it is no longer required for the stated purposes. However, we may have to continue to store your data until the expiry of the retention obligations and periods issued by the legislator or supervisory authorities, which may result from the German Commercial Code and the German Fiscal Code and usually amount to six to ten years. In addition, we may retain your data until the expiry of the statutory limitation periods (i.e. usually three years; in individual cases, however, up to 30 years), insofar as this is necessary for the assertion, exercise or defence of legal claims. The corresponding data will then be routinely deleted. As a data subject, you can exercise the following rights if the respective legal requirements are met: Right of access, Art. 15 GDPR, right to rectification, Art. 16 GDPR, right to erasure ("right to be forgotten"), Art. 17 GDPR, right to restriction of processing, Art. 18 GDPR, right to data portability, Art. 20 GDPR, right to object, Art. 21 GDPR. Right to object, Art. 21 GDPR: You have the right to object, on grounds relating to your particular situation, at any time to processing of personal data concerning you which is based on Art. 6 para. 1 sentence 1 lit. e or f GDPR. We will no longer process the personal data concerning you unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the establishment, exercise or defence of legal claims. You can object to the processing of your personal data at any time. You also have the right to lodge a complaint with a supervisory authority, Art. 77 GDPR i.V.m. § 19 BDSG. If you have any questions about data protection or exercising your rights, please contact datenschutz-ew@eurowings.com.
6. Changes to the conditions of participation and termination of the competition
EW reserves the right to amend the conditions of participation at any time. Should individual provisions of the conditions of participation be or become invalid, the validity of the remaining conditions of participation shall remain unaffected. Furthermore, EW reserves the right to terminate or interrupt the competition at any time without prior notice. This applies in particular to any reasons that would disrupt or prevent the competition from running as planned.
7. Limitations of liability
EW shall not be liable for damages that may arise in particular due to errors, delays or interruptions in the use of the website, in transmission, in the event of faults in the technical systems and service, due to incorrect content, loss or deletion of data, due to viruses or in any other way during participation, unless such damages are caused intentionally or through gross negligence on the part of EW. The above exclusions of liability do not apply in the event of injury to life, limb or health. Furthermore, the exclusions of liability do not apply in the event of negligent breach of obligations, the fulfilment of which is essential for proper performance, the breach of which jeopardises the achievement of the purpose of the contract and on compliance with which the participants regularly rely; in these cases, EW is only liable for foreseeable damage typical of the contract.
